{"id":274,"date":"2021-10-18T15:52:56","date_gmt":"2021-10-18T13:52:56","guid":{"rendered":"https:\/\/www.guides-belleville.com\/ski\/?page_id=274"},"modified":"2025-10-02T09:34:16","modified_gmt":"2025-10-02T07:34:16","slug":"terms-of-sale","status":"publish","type":"page","link":"https:\/\/www.guides-belleville.com\/ski\/en\/mountain-guides-belleville-val_thorens-menuires-st_martin\/regulatory-information\/terms-of-sale\/","title":{"rendered":"Terms of sale"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>General Terms and Conditions of Sale<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following \u00ab\u00a0General Terms and Conditions\u00a0\u00bb apply to the sale of \u00ab\u00a0Activities\u00a0\u00bb \/ \u00ab\u00a0Services\u00a0\u00bb by the \u00ab\u00a0Bureau des Guides des Belleville,\u00a0\u00bb located at 61 rue des Places, 73440 Les Belleville, a local professional union registered with the town hall of Saint Martin de Belleville, hereinafter referred to as the \u00ab\u00a0Bureau des Guides.\u00a0\u00bb These terms benefit any individual or legal entity, hereinafter referred to as the \u00ab\u00a0Participant(s) \/ Client(s),\u00a0\u00bb whether the service is purchased directly (in-person, off-site) or remotely (via telephone, postal mail, email, or the Bureau des Guides&rsquo; website at&nbsp;<a href=\"https:\/\/www.guides-belleville.com\/\">www.guides-belleville.com<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Activity Supervision<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The activities are supervised by:<\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li>A Mountain Guide with a state diploma in sports education.<\/li>\n\n\n\n<li>A Trainee Mountain Guide from the National Ski and Mountaineering School.<\/li>\n\n\n\n<li>A Mountain Leader with a state diploma in sports education.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These supervisors, hereinafter referred to as \u00ab\u00a0Supervisors,\u00a0\u00bb operate as independent contractors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Purchasing an activity from the Bureau des Guides implies full acknowledgment and acceptance of these terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I. Definition of Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bureau des Guides acts as a transparent intermediary between the Supervisor and the Client. It promotes and resells activities, collecting payments on behalf of the Supervisor.<\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li><strong>Mountain Guides\/Trainee Guides<\/strong>: Provide supervision, instruction, training, and safety in mountaineering and related activities, in compliance with the June 16, 2014 decree on specific training for state-certified mountain guides.<\/li>\n\n\n\n<li><strong>Mountain Leaders<\/strong>: Offer supervision, guiding, instruction, and safety in non-glacial mountain areas, excluding terrains requiring climbing techniques or equipment, as defined in the June 3, 2019 decree.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These terms cover only the aforementioned activities\/services, excluding transportation, accommodation, food, or equipment rental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>II. Activity Sales and Booking<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contract includes two parts prioritized as follows: individual agreements between the Bureau des Guides and the Client, and these general terms.<\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li><strong>Booking Process<\/strong>: Reservations are made directly via telephone (+33 (0)4 69 96 55 15) or email (<a href=\"mailto:guidebellevillevalthorens@gmail.com\">guidebellevillevalthorens@gmail.com<\/a>) and require the Client&rsquo;s personal details.<\/li>\n\n\n\n<li><strong>Confirmation<\/strong>: A reservation is confirmed once the Client completes the form, pays 100% of the activity fee, and the Bureau des Guides acknowledges receipt.<\/li>\n\n\n\n<li><strong>Failure to Pay<\/strong>: Failure to pay in full before the activity may result in cancellation.<\/li>\n\n\n\n<li><strong>Remote Sales<\/strong>: Contractual information is provided in a storable and reproducible format.<\/li>\n\n\n\n<li><strong>Cancellation Policy<\/strong>: See section V for specific conditions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>III. Right of Withdrawal<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clients are informed that, under Article L. 221-28 of the French Consumer Code, activity bookings are final and non-refundable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IV. Prices, Payment Terms, and Complaints<\/strong><\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li><strong>Price<\/strong>: Includes Supervisor fees and Bureau des Guides&rsquo; operational costs but excludes additional expenses like transport or food.<\/li>\n\n\n\n<li><strong>Base Fee<\/strong>: Starts at \u20ac650 for a daily guide engagement.<\/li>\n\n\n\n<li><strong>Payment Methods<\/strong>: Bank transfer (IBAN: FR76 1810 6008 1096 7366 3357 148) or cash.<\/li>\n\n\n\n<li><strong>Complaints<\/strong>: Must be submitted by registered mail within one month of the incident.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>V. Activity Changes or Cancellations<\/strong><\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li><strong>Weather and Conditions<\/strong>: Activities may be modified or canceled due to weather, terrain, or participant capability.<\/li>\n\n\n\n<li><strong>Cancellation by Bureau des Guides<\/strong>: Deposits are refunded minus incurred costs.<\/li>\n\n\n\n<li><strong>Cancellation by Client<\/strong>: Fees apply based on the notice period:\n<ul class=\"wp-block-list\">\n<li>More than 30 days: Full refund minus incurred costs.<\/li>\n\n\n\n<li>30\u201310 days: 30% due.<\/li>\n\n\n\n<li>9\u20135 days: 50% due.<\/li>\n\n\n\n<li>Less than 4 days: 100% due.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI. Technical and Physical Prerequisites<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clients must meet declared prerequisites and disclose health issues or apprehensions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VII. Organization<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clients must adhere to schedules, and delays may alter the activity. Participant numbers may be capped for safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VIII. Equipment<\/strong><\/p>\n\n\n\n<ul style=\"background-color:#eeeeee\" class=\"wp-block-list has-background\">\n<li><strong>Collective Gear<\/strong>: Provided.<\/li>\n\n\n\n<li><strong>Personal Gear<\/strong>: Clients are responsible for their own equipment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IX. Responsibilities<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Activities occur in specific environments with inherent risks (e.g., avalanches). Supervisors have a safety obligation but are not liable for natural hazards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>X. Insurance and Rescue<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Supervisors hold liability insurance, but Clients must have personal insurance covering the activity, including search and rescue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>XI. Image Rights<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clients authorize the use of their images for promotional purposes unless stated otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>XII. Dispute Resolution<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Disputes must be submitted by registered mail. Unresolved disputes may be referred to the MCP Mediation service:&nbsp;<a href=\"http:\/\/www.mcpmediation.org\/\">www.mcpmediation.org<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>XIII. Data Protection<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Client data is stored for five years and not shared with third parties. Clients can access or delete their data upon request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>XIV. Consumer Mediation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the French Consumer Code regarding the amicable resolution of disputes:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a consumer has submitted a written complaint to a professional and has not received a satisfactory response or any response within two months, they may refer their complaint, free of charge, to the consumer mediator.
